This Privacy Policy applies to all personal information collected by Launch Tutoring (we, us or our) via the website located at www.launchtutoring.com.au (Website).
1. What information do we collect?
The kind of Personal Information that we collect from you will depend on how you use the website. The Personal Information which we collect and hold about you may include:
- Contact Data: This includes your first and last name, email address, phone number, and home/billing address, used for communication, scheduling, and invoicing.
- Payment Information: We collect information necessary for billing and payment tracking, such as invoice numbers and payment dates. We do not collect, process, or store any credit card or bank account details from you. Payments are made via direct bank transfer to our account details as listed on your invoice, and we track receipt of payments internally.
- Academic Data: To customise tuition, we collect the student's name, grade level, school reports, and standardised test results, such as NAPLAN scores.
- Technical Data: We automatically collect your IP address, browser type, and usage statistics for website security and performance analysis.
- Parental Consent Data: For students under 18 years of age, we collect verifiable parental or guardian consent before collecting any Personal Information, including written authorisation to collect and process Academic Data and Contact Data relating to the student.
2. Types of information
The Privacy Act 1998 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.
Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:
(a) whether the information or opinion is true or not; and
(b) whether the information or opinion is recorded in a material form or not.
If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this privacy policy.
Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Australian Privacy Principles means the Australian Privacy Principles contained in Schedule 1 of the Privacy Act, which regulate the handling of Personal Information and Sensitive Information, including collection (APP 3), use and disclosure (APP 6), data quality (APP 10), security (APP 11), access and correction (APP 12 and APP 13), and accountability obligations (APP 1).
Sensitive Information will be used by us only:
(a) for the primary purpose for which it was obtained;
(b) for a secondary purpose that is directly related to the primary purpose; and
(c) with your consent or where required or authorised by law.
3. How we collect your Personal Information
(a) We may collect Personal Information from you whenever you input such information into the Website, WhatsApp designated group chats, google forms, or provide it to Us in any other way.
(b) We may collect cookies from your computer which enable us to tell when you use the Website and also to help customise your Website experience. We use both essential cookies (necessary for the Website to function) and analytics cookies (to understand how visitors use our Website and improve our services). These cookies may collect information such as your IP address, browser type, pages visited, and time spent on pages. As a general rule, however, it is not possible to identify you personally from our use of cookies. You can manage or disable cookies through your browser settings, though this may affect your ability to use certain features of the Website.
(c) We generally don’t collect Sensitive Information, but when we do, we will comply with the preceding paragraph.
(d) Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party, such as your child's school and/ or teacher. In cases like this, we will take steps to make you aware of the information that was provided by a third party.
4. Purpose of collection
(a) We collect Personal Information to provide you with the best service experience possible on the Website and keep in touch with you about developments in our business.
(b) We use your data to match students with tutors, create personalised learning plans, communicate progress, process payments, and improve our curriculum.
(c) We share necessary academic data and contact information only with the specific tutor assigned to the student to enable effective service delivery.
(d) We share information with trusted third-party service providers (e.g., cloud hosting for our website) who are required to protect your information confidentially. We do not use external payment processing services.
(e) We ensure that all service providers who handle your Personal Information are bound by written agreements requiring them to maintain confidentiality, implement appropriate security measures, and comply with the Australian Privacy Principles. We remain accountable for the protection of your Personal Information when disclosed to third parties and will take reasonable steps to ensure such parties do not breach privacy obligations.
(f) By using our Website, you consent to the receipt of direct marketing material. We will only use your Personal Information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from use. We do not use sensitive Personal Information in direct marketing activity. You may opt out of receiving direct marketing communications at any time by emailing us at launchtutoring2@gmail.com or calling us on 0478 796 330. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature.
5. Security, Access and correction
(a) We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure. When we no longer require your Personal Information for the purpose for which we obtained in, we will take reasonable steps to destroy and anonymise or de-identify it. Most of the Personal Information that is stored in our client files and records will be kept for a maximum of 7 years to fulfil our record keeping obligations.
(b) We retain different types of Personal Information for the following periods: (i) financial and payment records for 7 years from the date of the last transaction to comply with taxation record-keeping requirements; (ii) academic data, contact data, and parental consent records for 3 years after a student ceases tutoring services with us; and (iii) technical data such as website logs and IP addresses for up to 2 years for security and performance analysis purposes. After these retention periods expire, we will securely delete or anonymise your Personal Information unless we are required by law to retain it for a longer period.
(c) Your data may be processed or stored in overseas locations by our third-party service providers, including cloud storage providers, website hosting services, and communication platforms. These service providers primarily operate in the United States of America, and may also process data in other countries where they maintain data centres. We take reasonable steps to ensure these recipients handle your Personal Information in accordance with the Australian Privacy Principles.
(d) The Australian Privacy Principles:
(i) permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and
(ii) allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).
(e) Where you would like to obtain such access, please contact us in writing on the contact details set out at the bottom of this privacy policy.
(f) For students under 18 years of age, parents or legal guardians may exercise all privacy rights on behalf of the student, including requesting access to, correction of, or deletion of the student's Personal Information. Parents or guardians should contact us using the details provided in clause 7 to exercise these rights.
(g) While we implement strong security, we cannot guarantee the security of information transmitted over the Internet.
(h) In the event of an eligible data breach, we will notify affected individuals and the Office of the Australian Information Commissioner as soon as practicable in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth), detailing the nature of the breach, the information affected, and steps taken to mitigate harm.
6. Complaint procedure
If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us as on the contact details set out at the bottom of this policy. All complaints will be considered by Olivia Lea and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
